David Schulhof – for Music Licenser, the Song Remains the Game

WHAT does a rap song like Tupac Shakur and Dr. Dre’s “California Love” have in common with the new kids’ movie “Marmaduke”?

Not a lot. yet the song’s in the movie trailer, due to the handiwork of David Schulhof, co-founder and co-CEO of Evergreen Copyrights. Schulhof, 39, is in the business of acquiring the publishing rights to music catalogs and then finding new outlets for the songs.

since its launch in 2005, Evergreen has bought up an impressive stable of publishing rights, including the works of Roy Orbison, MC Hammer, the Ramones, Warren Zevon and Snoop Dogg.

sure, he gets nearly a dime every time one of those songs is downloaded from iTunes.

But Schulhof’s passion is proactively marketing his songs – reaching out to movies, TV, ad firms and musicians who might record cover versions.

want to cover “Pretty Woman”? You’ve got to pay Schulhof. Remember Kid Rock’s “All Summer Long,” which sampled Zevon’s “Werewolves of London”? He got a piece of that, too.

Growing up in new York City, Schulhof hit clubs like CBGB and the Bottom Line.

after attending Georgetown and then NYU Law School, the music lover learned his trade at Miramax, handling songwriter and composer contracts and producing more than 100 soundtracks.

@Work talked with the ever-enthusiastic Schulhof – now married with a daughter and living on the Upper East side – about finding ways to deliver cool music to the masses.

This is a bit rudimentary, but why would an artist sell to you?

one, liquidity. They get money. No. 2, they want somebody to promote their catalog. They want a partner to push the songs, find other artists to record them, find spots for them in film and TV and come up with new uses. otherwise, they sit there and die.

So you’re not just sitting back collecting royalties?

at least half my job is to find new revenue streams. I talk to agents, musicians, film producers, movie producers to include the songs in their future projects. I can create royalties from video games, advertising, Broadway shows, even when a song is performed on “American Idol.”

can you give a sense of what these songs rake in?

every time a song is downloaded off iTunes, that’s a one-time fee of 9.1 cents per song or up to a dollar on an entire album. National TV ads, we’re talking well into the six figures. for movie uses, it’s generally $30,000 to $80,000 depending on what it is. A movie trailer, that’s another, like, $50,000.

What’s the best way to make money from songs?

Tribute albums are great. we have one in the works right now for Nick Drake’s songs. But the real jackpot is a biopic. Think of the movie “Ray,” and how it boosted the catalog of Ray Charles.

we bought the right to Tupac’s catalog four years ago, so any biopic on his life will be huge for us. we also own the rights to the music of Bill Monroe, the father of bluegrass. When I bought it, I knew his life was a great story, and I’ve been pushing the idea of a biopic ever since. And now Maggie Gyllenhaal and Peter Sarsgaard are lined up to star in one.

What’s the most imaginative movie placement you’ve personally conceived?

I put a Third Eye Blind song called “Jumper” in the movie “Yes Man.” It’s Jim Carrey on the ledge, playing the guitar and singing “Wish you would step out from the ledge, my friend.” It’s perfect.

Do you make money on background music?

Absolutely. Elevators, malls, anywhere the music is played publicly.

You own a large amount of rap music. is that a cash cow, since rap is constantly sampling from itself?

Absolutely. we get stuff sampled all the time. They have to come to us for a derivative-use license. We’ll listen to the song and determine what percentage is derivative of our song. Then we’ll come up with an agreement – or sue if necessary.

What’s the most unusual rip-off you’ve experienced?

Somebody sent me a Thanksgiving card with MC Hammer dressed as a turkey with the song lyric “Can’t touch this” changed to “Can’t stuff this.” They tried to go in the back door through the parody and fair use defense, but we sued American greetings and won.

Why would you turn down usage of a song?

If it’s obscene, distasteful, overused. we turn down tons of requests. I’ll ask for the script pages or to see clips of the movie. We’re caretakers. We’re not just schlocking this stuff out. That’s why clients come to us, because they trust our judgment.

What’s your favorite part of the job?

I love waking up every day and hearing a song on the radio and thinking to How can I buy that song work with that artist?

Any advice for someone aspiring to get into music business?

It’s all about the song. There are lots of great artists out there, of course, but great songs are famous because they’re great songs. Nancy Sinatra didn’t want her song to be used in the “of Hazzard” movie years ago. Well, too bad. not her song. she didn’t it. Owning the song is best business to be in.

Ciara spent her Sunday trippin’ off the Power. The sexy singer performed last night at Power 105.1’s “Power Live” concert at Governors Island, featuring an all-star line-up including Diddy-Dirty Money, Keri Hilson, Kelly Rowland, Rick Ross, J. Cole and more.

Backed by two dancers, CiCi donned a jewel-encrusted Atlanta Braves hat and face-shrouding sunglasses as she performed her version of “Pretty Girl Swag,” while she removed the items and gave it her all on the smoking “Gimmie Dat.” The singer closed the performance with a sassy rendition of her hit “Ride,” which saw her getting down and dirty on the floor. Ciara’s upcoming fourth album, Basic Instinct, is expected to hit stores later this year.

Brandon Roy Apologizes for Appearance in Rap Video

Brandon Roy made a brief appearance in a rap music video, but felt the need to apologize once the video hit the internet and there were some things in it that he decided he didn’t necessarily want to be associated with.

The video can be viewed on YouTube here, and by most standards — in terms of people issuing apologies, at least — this one is relatively tame. It’s a positive that Roy is sensitive to how he (and to a larger extent, the league) is portrayed in these situations, but honestly, this is pretty benign in the world of athletes appearing in music videos.

And if for some reason Roy’s explanation didn’t do it for you, here’s what the director of the video himself had to say about it:

“The basic concept of Cali and Cavalli’s ‘What they Want’ is a rags to riches tale of upward mobility — a standard format that many have seen utilized in recent music videos. it depicts two small-time hustlers ascension from the inner city, where the perils of drug use and fast money are more than evident, to the metaphorical use of basketball and Cali and Cavalli’s association with two of Seattle and the NBA’s biggest success stories as their own personal barometer of achievement.

To officially clear the air Brandon Roy and Jamal Crawford weren’t involved in anyway shape or form with the production, concept, or content of the video and neither were present for anymore than a few minutes of the filming and for the most part were bystanders.”

That song by Soulja boy, Crank dat; and the song by Chamillionaire, Hip Hop Police are cut when on the radio..but i have heard both verisons from the internet and both are not cut they cuss…..but when previewing both Cds on itunes they both don’t say..Edited or Explicit content, also at stores they don’t either!! Could it just not say edited or explicit because they dont cuss enough? I previewed songs on the cd but itunes always cuts off right when i know there is a cuss word for hip hop police! but for Crank Dat it does infact not cuss(on itunes) but im so confussed if the CD is cut or not?!!? Does any one have these CD’s? or do you know if there cut or not because I do not want to buy cut CD’s!!!
